I think there is a gray area for any upcharged card. PSA in effect disregarded the declared value and substituted its own value determination, so limiting you to a declared value that PSA itself refused to honor doesn't seem equitable. As for the rest of the cards, well, the contract terms would dictate the outcome most likely.

I admittedly don’t know the legal aspects, but to me it seems like the declared value would apply if PSA lost the cards while they were still raw; however, after being graded they would have obtained a new value based on that grade in the current market?
