Packs seem fine. Nobody gives a refund without receiving the items back first.

but it says 14 day return policy I didn't notice the fraud until after the 14 day money back guarantee expired can I still get a refund?

also I contacted another person that bought an 81 topps rack box from him and the same thing his box was not a orginal 81 box. He didn't notice it either until like 30 days after he purchased the box. I strongly suspect dropthepuck20 is not on the up and up

you can get the refund if he is willing to refund, which he said HE WAS.

It's not necessarily a fraud if he made a mistake. Fraud is on purpose. We don't know if he did it on purpose. He is willing to give a refund, why not get a refund?

I contacted some of his other buyers and one of them gotback to me and said his rack box was no good

Sounds like a horrible case of frauf and you should be in full panic mode by now.

(actually, you are protected in many ways, not least of which is the fact that the seller said he'd give you a refund)

the problem is that he only offered a 14 day return policy and I didn't dicover the fraud until after 14 days. I feel if I return it now he will just keep the box and not give me my money back

Being an occasional seller myself I would loosen the rules a bit and give you your refund.

You should contact eBay and run your situation by them to see how the Buyer Protection Plan would work in this case. If eBay says you are still protected then contact the seller and tell him you are returning the goods for a refund. If there is a problem then you go through the normal problem resolution channels in place at eBay.
