Default Fiea Market rental Liability Insurance?

Hypothetical question?--if one rents a stall in either a Flea market or Antique Mall to sell or buy stuff--is it advisable to have liability insurance in the event someone fall's etc or would the owner of the building be responsible .-I do have insurance to cover a farm for accidents although my agent says they would have to show negligent but I would have lawyer in any event?

It likely depends on a particular state’s law, but in VERY general terms (read: not giving you any legal advice on which you may rely) you would not be liable unless you somehow created the condition that caused or contributed to the fall/injury. It is also possible that you could have a duty to warn of known hazards, again depending on the state and the innumerable factual scenarios that could arise, which are limited only by one’s imagination (and Plaintiffs’ lawyers have very vivid imaginations).

As for liability insurance, it is likely worth a discussion with your agent. It may not be very expensive and worth the peace of mind.

Usually when you rent space out the lease agreement that you review and sign would outline those things and who is liable. If it is not in there you can bring it up to them. Also in the lease it usually lists out the amount of coverage that is required or that is covered.
Regardless make sure it is in writing. Then if you are liable than or also partner with your agent for the coverage and the expense
