On Thursday, November 3rd, 2005, I received the auction items I won back in April, meaning Sergio Delgado has paid the auction invoice and paid the full amount he agreed to pay within 30 days of the contract he signed on April 15th.

I promised I would post when it happened, so here it is.

I'm reluctant to say he's paid what he owes me, but he did pay the amount that was in the contract that Jorge Marce wrote up for us.

Basically, I had the privilege of giving Sergio a 6-month, interest-free, $40,000 loan which he then used to buy more cards for his collection.

I hope you spent my money wisely, Sergio. I know I would have.

THANKS BIG TIME to Ryan for having the guts to force Sergio's hand and to make him either "pay up" or "miss out"!!

Heck, I would LOVE to be able to buy everything at auction that interests me by using an INTEREST-FREE loan from the auction house via a friend (like Ryan)...

but I never thought this was possible.

NOBODY should be able to buy things as auction on LAY-AWAY!!

As a lawyer I know you know to watch your words a little better than that. Some auction houses WANT you to do a lay away thing. In that case it's a win win....However, in Ryan's case, it was a lose-lose....and that isn't good....Don't be raggin' on acceptable layaways

Not just talking about Lelands, but how often does the auction house own the item they are auctioning? I know Lifson doesn't as a stated rule, but I've seen others buying up items for auction on set up days at shows. I would think they'd be more likely to accept layaways on house owned lots.

Hard to believe but many auction houses own the stuff they are auctioning therefore can do layaway..... I could name 3 major auction houses that I know do it from personal experience...though I haven't taken them up on it. They offered it as an option though. And they are 3 we all know and love...regards

I have no problem telling people that we buy items to include in our own auction. I think it's smart to do it that way. To be honest, if we had to totally rely on consignment items for our auction, there is virtually no way to make enough money to recoup the costs of the catalog production, mailing, salaries, etc...

As for a "lay-away" policy, I guess it would have to be run on a case by case basis. So far, we haven't had anyone approach us with it, and I'm not too keen on the idea; but if it was a good customer, who we knew was good for the money, I'd consider it.

Just a different perspective on the topic.

Yes, Julie, that is my understanding of the situation.

Ryan won some cards from Leland's that he could not receive until Sergio paid for them (which apparently has finally happened)...

but Sergio also won some cards for HIMSELF that he could not receive until paying for them...

and apparently Lelands opted for a "sure thing" sale to me rather than waiting another few months for money that "might" come.

I'm really hoping not to drag any of the auction houses into this, but I'll try to briefly explain what happened without going into too much detail.

I won the cards (that I just received) from a different auction house. Not Leland's. Leland's only enters the equation because I knew that Sergio was a bidder there, as well as other auctions. Knowing how Sergio does business with this one auction house, I figured he probably did the same thing with all of the others, without any of them knowing about the other. I mentioned to Leland's how Sergio was handling the situation with me as a cautionary tale in case he might owe them as well.

I can't say who decided what or how the next few steps happened, but you got some cards, and they got paid for them, so it was win-win.

All of these things are just examples of Sergio sleeping in the bed he made for himself.
