While there may be nothing wrong with selling re-backed cards that are advertised as such, I feel these may still be listed in a misleading fashion. The way the listings are phrased, such as "T206 Nap Lajoie Good RE - backed with Polar Bear back," makes it appear to some buyers as though the condition is "Good RE," whatever that might mean, or just that the RE means something else, not that the card is re-backed with a different back. It looks to me like the seller is trying to technically comply with the rules but still hopes to mislead a buyer.

I also think the idea of re-backing cards is pretty dubious, since the only real reason I can think to do so would be to trick someone somewhere down the line. So even if these sales are properly disclosed (which I don't think they are), the seller may in some way be facilitating fraud if the buyer goes and sells the re-backed cards to someone else.
