Legally speaking the buyer may have a right to file a claim against the seller but morally speaking, I don't think he should.
I know it stinks, but why go after someone you know isn't at fault just for the money? Better to go after the real crook, (flyer guy or post office), and not get your money back, than to go after an innocent person just for money.
