I don't see any fraud here. It's listed as a "novelty aged reprint"

Yes the seller DID do something wrong. This isn't a reprint, it's a counterfeit. Just because he's not trying to pass it off as genuine doesn't give him a pass for selling something that is, in essence, illegal.

According to the dictionary, "counterfeit" includes the intention to defraud. If the seller made this card themself, with the intention to sell it with full disclosure of what it is, I find it hard to accept that they did anything wrong.

OPs point stands, though—it certainly could be used by someone later to try as pass off as an original. (Or it may have even been made by another owner previously for this purpose).

I agree but no one is going after this crime.

And, I agree with Brian, the buyer could be the next seller of fakes, acting like they are real. It only happens daily. Caveat emptor nowadays more than ever.

If I sell a fake Tiffany bracelet, and announce at the auction it's a fake, that doesn't make it legal.

Maybe I am missing something here...reprints/counterfeits have been on eBay for decades...this is not even a good one, imo. Seller lists it as a reprint. I see nothing wrong. Maybe this is an eBay issue for allowing reprints then.

I don't think they allow knock offs of up scale handbags or watches so do away with the unauthorized reprinted cards.

How is a poor quality obvious reprint listed and sold as a reprint an example of copies getting better and fraud getting worse as a result?

I am not a lawyer, but in your example, the legal issue is trademark infringement, no? Does this apply to 100+ year old baseball cards with ads from long-defunct brands?
