If I remember right there has already been case involve ....sucks.com and the company involved lost the case to have the site shut down. Most sites like these are quietly bought up by the named company and never used but they continue to pay the anual fee to keep others from owning it. If eBay were to yank the auction, I would think it would be a good example of how eBay is more than just a host for auctions. This what they claim in lawsuits to avoid legal responsiblity for all the shennanigans that go on. |

With celebrity name sites (ala www.georgeclooney.com), it depends on how the owner is using the site. If the owner likes Goerge Clooney and uses the site as an unofficial George Clooney fansite that can be okay. If the owner is using the site commercially, such as to sell T-shirts or pornography, that would not be legal and Clooney could take over the domain if he wished. |

That is exactly what Porsche's legal representative told me, I really had no idea when I purchased the sites though. The shame of it all is that the Domain providers (domain.com, etc) feel no obligation to refund a buyer yet at the same time they feel no obligation to stop selling domains that are copyright protected or cyber squatting infringements. |

This reminds me of why I added a hack saw to my hobby tools. I started out NEVER buying slabbed cards... but then along came one at a reasonable price, a card I wanted, so I bought it, a T206 Kling. He'd committed no crime, so I freed him from his imprisonment. |

Dan, I don't beleive you were required to automatically give up all of your domain names before you even used them. Just because Porsche's representative told you something, doesn't mean it was correct or that he beleived it was correrct (it's called intimidation). I don't know how you were going to use the sites, but, even Porsche's own argument (celebrity domain use) showed that there was a way for you to keep and use a Porsche-related domain. |

Porsche literally stated that if I used the sites for ANY reason, they would sue. They are a very particular bunch of squirrels. When I had my cars serviced, it was at a placed called Eurosport here in Virginia Beach, the funny thing was that all they worked on was Porsche's and they have many Porsche certified mechanics on their staff. Yet, they could NOT post a Porsche sign (emblem) or even the word Porsche on the side of their building or business cards or they would be sued. |
