If I remember right there has already been case involve ....sucks.com and the company involved lost the case to have the site shut down. Most sites like these are quietly bought up by the named company and never used but they continue to pay the anual fee to keep others from owning it. If eBay were to yank the auction, I would think it would be a good example of how eBay is more than just a host for auctions. This what they claim in lawsuits to avoid legal responsiblity for all the shennanigans that go on.

and a few others that were Porsche related, obviously due to my addiction to Porsche's. Needless to say, I never even launched the sites and before I had the chance to, I had legal notice by Porsche that they were going to sue me for even having registered the names. They said I could not use them and they were not interested in buying them. I let the sites go after the year I owned them, sold my two 911's and bought a Viper to replace them. I am still not sure who won that battle.

With celebrity name sites (ala www.georgeclooney.com), it depends on how the owner is using the site. If the owner likes Goerge Clooney and uses the site as an unofficial George Clooney fansite that can be okay. If the owner is using the site commercially, such as to sell T-shirts or pornography, that would not be legal and Clooney could take over the domain if he wished.

The key being that, while it can be okay to have a informational site about Porsche or Bill Gates or PSA, you cannot use a famous person's or company's name as the devise that makes you money.

That is exactly what Porsche's legal representative told me, I really had no idea when I purchased the sites though. The shame of it all is that the Domain providers (domain.com, etc) feel no obligation to refund a buyer yet at the same time they feel no obligation to stop selling domains that are copyright protected or cyber squatting infringements.

I learned my lesson and moved on. No big deal.

This reminds me of why I added a hack saw to my hobby tools. I started out NEVER buying slabbed cards... but then along came one at a reasonable price, a card I wanted, so I bought it, a T206 Kling. He'd committed no crime, so I freed him from his imprisonment.

Since then, I've liberated other innocent cards. Hope it screws up the population reports.

I don't know if this new cereal is any good, let's let "Mikey" try it... I can't tell if this card is worth a damn, let's pay some fat cat who's hired idiots to tell me... Why not let them tell you which cards to collect, too. And how much to pay for them. And they could store them too, just send you a scan.

Dan, I don't beleive you were required to automatically give up all of your domain names before you even used them. Just because Porsche's representative told you something, doesn't mean it was correct or that he beleived it was correrct (it's called intimidation). I don't know how you were going to use the sites, but, even Porsche's own argument (celebrity domain use) showed that there was a way for you to keep and use a Porsche-related domain.
If you had porschefanclub.com for your non-commercial Porsche fan club, and Porsche wanted the domain, they would have been free to offer to buy it.

In defense of the Porsche's of the world, there are people in the past who would buy a company's domain name and say the company is free to purchase it ... for $100,000,000. These days, a person would be able to be compensated reasonably for the domain name, but very far from millions of dollars.

The PSAsucks.com case is bit tricky (free speach), though obviously is a commercial venture. This is obvious due to the extremely high asking price (sale price of a domain is relevant legally) and that it is advertised as "unlimited financial potential." Both sides would have legal arguments in this case, though I would guess PSA would win.

This is all very interesting chatter.

I'm also surprised that this hasn't been knocked down either. It was knocked down before and I'm pretty sure Joe and company are planning some kind of attack. It's obvious that eagle has no intent on selling the site name but simply adverise to the world his feelings on the grading company.

I'm not a domain squatter but a fan of a particular musician. I purchased the domain name several years ago and was contacted via the telephone by the musician stating he wanted his domain name. He gave me his home phone and told him to call me back. I did so and he was concerned that there was going to be another Samuel L. Jackson situation where I would ask two million and he would have to hire lawyers and I would have to hire lawyers. I told him that it wasn't my name and I had no right to it and simply gave him the domain name. A few months later, we had dinner after a concert and he signed some memorabilia for me and offered me a lifetime of backstage passes.

Porsche literally stated that if I used the sites for ANY reason, they would sue. They are a very particular bunch of squirrels. When I had my cars serviced, it was at a placed called Eurosport here in Virginia Beach, the funny thing was that all they worked on was Porsche's and they have many Porsche certified mechanics on their staff. Yet, they could NOT post a Porsche sign (emblem) or even the word Porsche on the side of their building or business cards or they would be sued.

I offered for Porsche to buy the domain names for the price that I paid, a whopping $11.99 each and they told me NO, they are not interested. I was floored, thus the reason for my selling both cars and telling them to stick it in their caboose. I love the cars still today and every time I see one when I am out cruising in my new ride, I make sure to leave them in the dust!!!
