Yes, this ad or type of ad with Wagner's picture being used without his permission might have led to his complaining and having the card withdrawn. However, the small population of his cards in circulation makes me wonder if he found out earlier in the printing process and complained. He may have told people that he didn't want to promote smoking but he might also have been upset that he was baseball's biggest star in 1908-1909 and nobody offered him any compensation for using his image.

Here are 2 other Hindu ads I have that are slightly different from the ones already shown.

Does anyone have a theory as to why many cards are depicted with the name along the top border?

I see that on some of the ads the player name would be obscured if it was on the bottom border but on other advertisements there is sufficient room on the lower border but the name is still on the top border.

Because they wanted to show a card coming out of the pack. Can’t do that and have he name at bottom if you want to also identify the player shown in the ad. The others with the name at top all have the bottom fully or party cut off by the angles and design in other ways. When the bottom is complete the players name is often put there. Just an inconsequential, at the time, moving of a minor design element to better fit the graphics they wanted to use.

There were 26 different Old Mill ads and each one had a "Texas League baseball pictures" and "Baseball pictures" version for a total of 52 ads.
