I believe you are correct sir. I would think Legendary is smart enought to slab something like this if it was a type 1 and also "smart" enough not to when it is something else
Personally.. I would pass on the Legendary photo unless they guarantee a type 1. Unless you do not care about a type 1 distinction..in that case, just DON'T pay type 1 money..
