If whips don't hurt, what is the rationale for suspending jockeys for "aggressive use of the whip"?

Also, the quote below, is from an AP interview with Larry Jones, the trainer of the tragic Eight Bells:

"I don't think we need to make (the whips) out of foam rubber, but you could get to a happy medium where you know it's not going to hurt them and the horse would still know what you want them to do."

Sounds like Jones believes that whips hurt.
