My general understanding is that there has to be some element of ORIGINALITY/artistic expression in order to copyright something. Not sure a photograph whose claim to fame is that it accurately reproduces something else qualifies, but then again I suppose it wouldn't take much to claim that there was something original about the photograph, e.g. the way it was composed etc.
