In many states, refusal to submit to a breathalyzer means an automatic suspension of the driver's license for one year-- irrelevant to what other tests prove or disprove. A driver's license is considered a privilege, not a right, and agreeing to the test is a condition of the privilege. One could have all charges dropped, all other tests come up roses, and still have the suspended license because of the refusal.

Whether innocent or guilty, refusing the test is a dumb thing for the testee, as it will only hurt him.
