Pull out your Sotheby's/SCP catalog and look in the section setting forth the rules. I think it is very possible that it will contain a choice of law or forum selection clause setting forth which state's law will apply or where suit must be filed. If it does, and assuming that those provisions are enforceable, you will then be in a better position to determine your potential remedies and the answers to some of your other questions. Good luck.
