PSBarry first of all I am only saying that a good plaintiff's lawyer could make the case for additional disclosures. I personally think an auction house is entitled to rely on third-party grading because that is what they are offering, a card graded by the third-party whose name appears on the flip. But in any event you are right that if information is not knowable, there is no liability for failing to disclose it. Now maybe I shouldn't speak so fast because perhaps our friend Kenny could come up with a plaintiff's argument there too. Indeed, I do recall him posting something once about a cause of action for INNOCENT misrepresentation, if memory serves correctly.
