davidcyclebackI would say, 1) The seller has to to say what it is in no uncertain turns ('It might be,' 'It could be,' isn't saying what it is), 2) Have a legitimate authenticity guarantee and return policy ('Sold as is' isn't a good guarantee). The policy isn't so just for the policy, but also a demonstration of the seller's confidence in what he sells. For example, an autograph seller with a lifetime authenticity guarantee suggests he's confident in the authenticity of what he's offering.
