I don't think you need to disclose anything - if the card is currently slabbed, it graded. Anything prior to that is just debatable opinion.

As to refunds if it doesn't grade elsewhere in a cross-over, no on that too. I think that anyone that cracks a card out of a slab does so at the risk the card may never see that grade again, for better or worse. That's on the person that cracks it out, not the person that sold it to him.
