Peter SpaethIn a trial nearly all the stuff we form judgments on would be excluded for a variety of reasons, including hearsay, lack of foundation, improper opinion testimony, and so forth. Absent eyewitness testimony or admissions, the best one could probably do is build a circumstantial case with documentary evidence comparing someone's purchases to their sales. A consistent pattern of improved grades would suggest that the person is altering cards, although it would be very hard to prove and extremely difficult to prove beyond a reasonable doubt if it were a criminal proceeding.
