I wouldn't get all bent out of shape about it. The seller probably wasn't aware that a few of the cards in the set came from a sheet that was chopped many years ago. In any case, I don't think either of the two cards you have pictured are deceptively altered. If the seller guaranteed you that all of the cards in the set would grade, it was probably just an oversight on his part.
