If an Old Judge has been skinned, there's nothing wrong with putting a backing onto it. It might not be a good thing to have it lying around without any support.

If the card is going to be put on the market, I agree with those who say it's not wise to have the new backing mimic the original. But who said the backing has to resemble the original? Have a blue or a red backing or dark green backing.
