He isn't using that category yet and I don't think he will. I don't think eBay requires you to list in a certain category either (or won't monitor it). He probably will use the argument that his cutouts are graded so he needs to put them in the graded cards category. We'll see if he has an ounce of ethics soon, if he starts listing in the category that was made just for him, but don't hold your breath.
