The 'legit' spammers (one that use opt-in rather than opt-out mailing lists) are their own worst enemies. They have fought any sort of legilation regarding spam.

BEst idea I've ever heard, but don't how it would be inplememnted, would be to charge 5 cents for every email sent. If the email is accepted, you get the 5 cents credited back to you. If it is not accepted or undeliverable, you are stuck paying the 5 cents. How many spammers would last if they sent out a million emails and got a bill for $49,500 (assuming 1% accept it).
