Yes the seller DID do something wrong. This isn't a reprint, it's a counterfeit. Just because he's not trying to pass it off as genuine doesn't give him a pass for selling something that is, in essence, illegal.

According to the dictionary, "counterfeit" includes the intention to defraud. If the seller made this card themself, with the intention to sell it with full disclosure of what it is, I find it hard to accept that they did anything wrong.
OPs point stands, though—it certainly could be used by someone later to try as pass off as an original. (Or it may have even been made by another owner previously for this purpose).
