If he classified it as graded, then probably. But he did say -
"I sold this card June 27, but the case broke in transit to Ebay Authentication. Could not complete sale due to damaged case. Card and holder will be shipped to you,"
Ebay doesn't read they just plow ahead. I have seen worse on my own stuff.
