I agree with this approach, at least assuming that it's possible to successfully execute.
I guess my only question is whether they really will be willing (and able) to be that flexible. I would be paranoid that step 1 would be cracking it out of the current case, and by the time they decide whether or not a downgrade is appropriate, it's too late to put that genie back in the bottle and go back to just the original cracked case.
Most of my paranoia stems from the TPGs not being really responsive to customer requests, particularly when it disrupts the normal flow of the grading process. Or you could argue that they're not real responsive in general, which further proves the point.
