ebay Authenticity Guarantee did not pick up reprint!

Hi Gang:

Anyone ever have a card that went through the ebay Authenticity Guarantee where they made an error?

Without getting into the specifics for now, I won a card and it went through the Authenticity Guarantee process and it passed.

When I received the card it was an obvious fake where a reprint card was used and either a fake back or an original back was used for the reverse.

I called ebay and was told the rules of the guarantee for trading cards is I have three days after receipt to contact them with concerns. For various reasons it is past the three days

My question is has anyone had a situation where the ebay Authenticity Guarantee was wrong? If so how did you proceed.

Seems to me if they make an error and it can been proved/shown to them they should honor a refund.

I am currently in a holding pattern while ebay examines whether they should give me a "courtesy refund"

The seller had "final sale" in red in the listing. Interesting that his other listing just says "Seller does not accept returns"

Wanted to go through ebay before contacting the seller

So you can’t tell if it’s a fake back or real back? What was your indication it’s a reprint, have some pictures you can post?

Not willing to get into specifics yet. It is an obvious fake because of the front of the card. There is a tell tale sign the front of the card is a reprint.

It has what looks like a real postcard back that has somehow found it's way onto the back of a reprint card

I would send it to PSA for encapsulation and grade. When they send it back to you as a fake then you have a case.

The seller's obligation ends when it passed authentication, although of course they could voluntarily refund you.

Do you have any recourse through your credit card company?

Were you not able to see this sign on the ebay listing?

This is a reason to only buy thru the auction houses.

Lawyers are often treated as nuisances (sometimes on this board too) until one has legal questions.

Please pm me if you would like legal assistance (pro bono).
