Anyone have luck recovering a PP gift payment?
 
So I finally got stung on a PP gift payment. Seller SIGNED for return, but won't refund. I'm afraid if I open a claim with PP, and it is denied, I will lose the ability to file a claim in Court. It is an amount large enough for grand larceny.

Any help is appreciated!

It seems like if the seller requested PP Gift as a form of payment, then you should have some recourse. If it was you that offered PP Gift, it might be harder to recover. Good luck.

I, too, would like to know if it was a board member.

Not a board member unfortunately. I wouldn't think it mattered who initiated the gift. In retrospect, I should have had him invoice

Why do you think if you file a claim with PP and it's denied, you would lose the ability to file in court? Just curious..

My own small mindedness. Couldn't his defense be pp found in his favor? I think since he signed for the return, they would side with me, but really not sure how to proceed

Yeah, but your argument could be that you're using every option available to recover your funds. I'd start with PP and work my way up the food chain. Once the guy sees your serious, he may decide to refund your money anyway.

My only advice is quit trying to steal from PayPal and these things would not happen. That being said I hope you do get you item/cash back.

No the pp denial is inadmissiable......just like if you challenge something with your credit card and your credit card company denies a refund ...you could still sue..pp and your credit card have their own guidelines....

you still have a cause of action in court for sure if you lose the pp challenge but I think that's the risk you have with 'gift' on pp..that if you try to challenge you probably lose...but if free who cares could be worth a try
