Maybe, but this guy has 1400 listings so more than likely it is an honest mistake. You could message him and tell him about it and I'm sure he would be appreciative.

Not at all. A lot of sellers use this marketing strategy. A lot of people filter out BINs in their search criteria, so this way it shows up either way.

If a buyer clicks the BIN, he simply ends the other auction early. Or if the auction item is about to end, he can always end the BIN. Either way, he has nothing to loose as long as he stays on top of things.

Yes it is, I suspect that since one in an auction and one is a BIN that that is different. He could not have it listed twice as a BIN or as an auction.
