Default Seller who doesn't deliver the goods

I recently spent over $300 on two cards, neither of which was delivered. The seller jockeyed around for a while, now ignores my emails and phone msgs. Since he is in the state of New york, do I have to file in court there, or can I do it here in Georgia? I would like to do this on my own and wrap it around a visit to New York. Cost isn't an object, but I don't want to spend thousands in legal fees over $300 - on the other hand, no one rips me off, period.

BTW, the seller is "the-baseball-gallery" on ebay. Thoughts?

Hi Scott
I had a similiar problem with a seller on ebay about 6 months ago. Lot's of promises, excuses and then the silent treatment. I called their local Sheriff's department and they sent a deputy to the residence to inquire and 3 days later I got my merchandise.
