Default Hillerich & Bradsby "SLAPPed" down

This morning the court granted Robert Plancich's motion to strike the complaint of Hillerich & Bradsby under the California "anti-SLAPP" law, ruling that Mr. Plancich had established that the case involved conduct in furtherance of his First Amendment rights about a matter of public interest and that Hillerich & Bradsby had not demonstrated a probability of success on the merits. H & B can appeal the Court's judgment against H & B once it is final, obviously, but for now their case against Mr. Plancich has been decided against them.

Good work, Adam. You were absolutely correct in your analysis about the state's anti-SLAPP statute.

Adam.

Great work in court. Next step will be to see Robert go back at H&B for harrassing the "little guy". Maybe he will own H&B when it's all over!!

I guess David still beats Goliath!! H&B got what it deserved trying to step on the little guy and quiet him.

Adam,
Great work! Read the motions, both excellent. This is just an example of how important an attorney can be. (lets hope this puts an end to the lawyer bashing!!)

Can anyone post a link to the actual motions/briefs or can someone post so that we all can read them?

Josh,

Lawyer bashing on this board? I'd be afraid to be hit with a libel suit!

Nice job Adam! By the way, does this mean that Robert Plancich is going to refrain from posting on this board in the future? I hope not.

Adam,

I enjoyed reading your motion. As I strongly suspected, there was no reasonable defense to it. There never seemed to be any merit to H&B's claim against Robert and this decision affirms it.

Looks like Joe and Aaron aren't going to get their day in court. Guess they will continue to sit confortably in their win-win Barcaloungers.

Congratulations, Adam! Score one for the little guy.

I would imagine SCDA and Mastro are actually relieved the suit was dismissed so quickly, although I'm disappointed their practices weren't given the chance to be scrutinized by an unbiased examination.

Adam,

Since the ruling was in Plancich's favor, is it possible for you to post the court papers or provide a link for those of us who are curious to be able to read them? Some other posts say that they have read the proceedings. Can you direct us to where we can read them as well?

The Los Angeles Superior Court's branch courts (this one was Pasadena) have not progressed to the point where filings are scanned and loaded or electronically filed. However, anyone truly interested in the moving papers and reply papers I filed can have them via email--just send me your email address and I will respond with the papers. I don't have H & B's unsuccessful opposition on electronic form, but my stuff was better anyway
