Steve-
That is horrible. I can't see how Fusco could have screwed up twice like that. You have an online bid that exceeds the supposedly winning bid. On top of that, you also have fax confirmation showing another bid that exceed the supposedly winning bid.

It sounds like Fusco is trying to renege on two valid bids.

I find ebay live to be a total hassle, and don't even use it. But when you finally find the last card in a set and then have this happen, it's pretty awful.

I can just echo the sentiments of everyone else Steve. I will say I'm not real happy with Fusco either. The item I won Saturday doesn't compare to Steve's loss...I think mine is around $200 total, but it frustrates me when you can't even get a invoice relatively quickly from some of these ebay live auctioneers. I know they have a bunch of lots...but would still be nice if at least some type of email went out in the first 72 hours.

Several years ago, I bid on my first and last ebay live auction, which also was with Fusco. It was a Chief Meyers photo with him in a black N Y Giants uniform. My bid was also higher than the winning bid, and was made earlier as well. Same situation as your's Steve, and I have never bid on an ebay live auction again.

I'm not sure what's been up with ebay live lately as I apparently shilled myself up on a recent Hassinger-Courtney auction lot. It's definitely small potatoes compared to Steve's situation, but still a little annoying. I was away from the computer that day so I put in my high bid through ebay and when I got home I somehow had the three high bids in the auction with no bids in between mine. It still was not even near my ceiling bid, but I have no clue how that happened.

I had an incident with a FUSCO ebay LiveAuction a few months back were someone on the floor bid $475, which triggered my absentee bid of $500, but somehow it was sold to the floor bidder at $500. If the floor bidder had bid a straight bid of $500, then he should have had precedence, but once the floor bid $475, I think my bid of $500 should have been high unless the floor bid went to $525.

Steve: I don't know you personally, but understand your frustration. As stated above, I have also experienced issues with the live auctions feature. On the other hand, I know Paul and Josh from Fusco and have found them to be honest, decent people. I'm sorry this has happened to you and truly hope that some sort of resolution can be reached. If not, no matter how difficult it might be from your standpoint, please hear Fusco out for whatever they have to say. I can tell you that I've never known deceit to be part of their usual m.o. I have no personal or professional obligation to say any of this--it's just my opinion. I really wish this had worked out better for you.

To all members of the forum. We offer a public apology to Steve. We have already apologized to him three times presonally and now we will do it on the forum. There was no attempt to deceive him nor any games played. The facts are simply this. We did not receive your fax Steve. Period. I know that you show a transmission on your end saying that it went through. It did not. Period. So we do not have it when the auction started and therefore could not exercise you bid of $2100 as we didn't know it existed. I understand that you are frustrated but if you wanted the piece that badly don't you think it would have been a good idea to pick up the phone to see if indeed we received your fax. Do you really think would have ignored a $2100 bid on a $1100 piece?? As far as the eBay live module goes, as auctioneers, we do not see the proxy bidding on eBay prior to the auction. Nor do we see any of the bids eBay has accumulated for each lot right up to the point where the lot opens. And only then do we what eBay tells us is the high bid that they have received in incremental form. When I first looked at the bid history after the auction when you made me aware of the situation, it did not show your bid. When I looked the again it did. It showed that the lot was sold for $675 with a three way tie between you and two other bidders. It also showed that our eventual winning bidder was on top with another bid hidden by an asterisk. When you made me aware of the situation and that your bid was $700 thru eBay, I called eBay to see what the problem was. The high bidder thru eBay was indeed the person that we awarded the lot to as his bid was in the four figure range. Had eBay live module been working right, which we did not know at the time that it wasn't, the high bidder actually should have gotten the lot for $725. So without your fax bid of $2100, WHICH WE NEVER RECEIVED, you would have not won the lot. Again, we apologize for the mishap but it not because of anything attempted deceipt on our part. As I told you via email, I would been more than happy to exercise your fax bid of $2100 if we had received it. My consignor would have been happier and you would have been as well. This was not a mistake or attempt to deceive you on out part. We called the winning bidder on your behalf and tried to get him to sell you the piece at a reasonable price. He was also looking for this piece for a long time so he refused. Steve, we did everything we could to make this right. We've apologized five times now. We did not attempt to deceive you or make a mistake by not enetering your fax bid. We simply did not receive it. I don't know what else to say. Since eBay has decided to suspend the live auction format at the end of the year, their support of their current platform has fallen off. We are currently talking to several companies to put the auctions on our website to avoid the hassles with eBay live.

Thanks Paul. On the way in this morning I had decided that I was over it. After all it's only cardboard.

Some lessions learned:

1. Don't rely on eBay to get it right;
2. Fax it twice, maybe thrice; and
3. If it is really all that important call the Auction house to verify they have your bid.

Mixed feelings there. One the one hand it is a crappy platform: badly executed, frustrating to use. On the other hand, (because it is a bad platform, I suppose) I've gotten a few great deals in it. It also let me show my daughter what a live auction was like when we sat together and followed a big N269 collection being auctioned. It was really quite exciting to bid in the live portion of the live auction.

To those of you who don't know me, my name is Josh Siegel. I am the one of the auctioneers at Fusco Auctions. For those of you who do not know me, I have been in the hobby for the better part of the past two decades. I have been working for Fusco Auctions for eight years this fall. I have enjoyed meeting many people, not only on this forum, but within the hobby. I have handling the primary duties for our Sports Card & Memorabilia Auctions. I personally do the cataloging and research, consignments, authentication, assigning card grades, and the other 500 duties that an auctioneer handles. I am a little wet behind the ears when compared to many of hobby veterns. With that said, I need not let Paul take the brunt of the heat. This is the first time anything in an auction I have been part of has ever been called out and I am not sure what to say. So i will say this: The two fo us handle all of the pre-auction bids. I personally removed about half a dozen faxes from the fax machine on Friday and more on Saturday. As I enter the bids any new customers get entered in for mailings. I NEVER received a fax bid for lot contested. Sorry you missed out on the lot Steve as I collect myself and would be sick if I missed out on an item I needed so bad. If I had misplaced the fax I would own up to it. I double and triple checked and it was not over looked. As far as the eBay bidding goes, we have zero control over the bids. eBay executes the bids, period. The winning bidder left a bid above $1000 I am told, so eBay should have proxy bid the lots accordingly. Here is the bid history on the lot. If you look, there are three bid amounts at $675. The top listed bid is the eventual winning bidder. Based on these bids, the lot should have opened at $700. The asterick indicates the bidder's max bid have not been exhausted. Based on this, eBay executed Steve's bid up to $675.

I hope this helps give my perspective and I also acknowledge that the eBay Live (and eBay in general) format can be a turn off at times. Also, In response to Dave F.....If there is something you are not happy with please let me know about it. For the record, the auction on Saturday began at 5:00 PM and concluded about 9:30 PM. All of the invoices were sent out by 5:00 PM today. If my math is right, all of our winning bidders received their invoices withing "72 HOURS" of the start of the auction. That means we packed over 200 items in two days!!! Don't worry, I'll be shure to come in on Sunday's from now on! I know, I know... family comes second right!

Josh-

I stand corrected on this one. Your right at 72 hours yesterday I had my invoice, which was paid in about two minutes. I've used the live-bidder process on ebay now about five times. The other four times, the quickest I had an invoice was about four days...with two taking over a week.
