Default Library of Congress Images - selling

I asked the LOC if selling the baseball card images on c.d. was legal. Their response:

As a publicly supported institution the Library generally does not own rights to material in its collections. Therefore, it does not charge permission fees for use of such material and cannot give or deny permission to publish or otherwise distribute material in its collections. It is the patron's obligation to determine and satisfy copyright or other use restrictions when publishing or otherwise distributing materials found in the Library's collections.

Included below is the Copyright Statement that accompanies the Baseball Card collection. You will want to read this before deciding whether or not
to buy items from this seller.

The Library of Congress is providing access to these materials for educational and research purposes. The written permission of the copyright owners and/or other rights holders (such as publicity and/or privacy rights) is required for distribution, reproduction, or other use of protected items beyond that allowed by fair use or other statutory
exemptions. Responsibility for making an independent legal assessment of an item and securing any necessary permissions ultimately rests with persons
desiring to use the item.

While the Library of Congress is not aware of any U.S. copyright protection (see Title 17 U.S.C.) or any other restrictions in the Baseball Cards
materials, there may be content protected by copyright law. Additionally, the reproduction of some materials may be restricted by privacy or other rights.
