Posted By: <b>leon</b><p>Even though Bill Mastro had sold his company I believe he still had daily activity at Mastro Auctions and was still very much in the scenes at shows, events and functions, at least from what I saw around the Nationals I have attended. I don't believe he will be affiliated with the new company in any capacity. It does look as though the other 3 top executives have gone to form the new auction house. I know all of them and I wish them the best. Doug has always been a strong supporter of Net54 and it's appreciated. As a matter of fact Doug has already said he would like to speak again this year at the 8th (I think) National Net54 Dinner. best regards<br><br>edited to add that one of these threads at the top is enough

I even asked if he could get my latest winnings out soon and he said no problem. I am quite sure no consignor or winning bidder will lose a penny in the transition. The top 3 folks have been in the hobby a long time and are still in it. regards

Among other things, this means that the new owners of the assets generally do not take over Mastro liabilities. Usually this is in play for possible future environmental issues, product or employee lawsuits, etc. But along with shedding the name, they've shed liabilities for the most part too.<br><br>Not sure it's a factor here. Most buyers want an asset deal rather than a stock deal for a variety of reasons, not just the liability considerations.<br><br>J

Selling $10,000,000 record auctions to slipping away literally over night. <br><br>the economy and trust issues are not going to make this an easy path. i think they should have waited and made this seem more like a brand new venture. this to me is lipstick on a pig. <br><br><br><br>

Seems like a lot of short term thinking going on by those guys.<br><br>Some people will still be suspicious about them and think there is something crooked going on. But I have to believe that the new heads of Legendary Auctions don't really care about those few people. They have a bunch of consignments for their next auction in April and are eager to reap the $$ from those sales. Is that short term thinking? Yup. <br><br>Long term they will continue lose ground to REA and others, as future consignors see the huge sums and top notch items being sold by other houses. But there is enough of an established base of people who will consign and bid in their auctions to keep them humming. No disrespect meant, but the 20 or so vocal people here, who disdain them won't prevent the people who run the place from making a good living. Mastro was once upon a time at the top of the heap. Now they are headed to be a second tier auction house (at least in sports). But can you still make a good living running a 2nd tier house? Yup.<br><br>PR-wise I would say from reading their press release that these guys have heard the complaints about Mastro customer service. It will be interesting to see if they can improve the service so many people complain about.

Maybe the hobby is changing for the better, or this is just a sign of things getting worse. Interesting story and maybe we can all learn something about what really happened. Hate to post openly about it but they said it was mailed 12 days ago (way past their 45 day commitment) and the past few days they have not been picking up the phone nor responding to voicemails/emails (now I see why). They have an opportunity to make this right of course but with 0 customer service and a convenient change of identity I'm just trying to figure out what kind of fight I am in for.<br><br><br><br>Update: Just got a call from Mastro (perhaps the awesome power of this board?) and they said they will be cutting a check and mailing out. So while it was not mailed when them claimed 12 days ago it does sound like they are working to resolve outstanding stuff which is all I can ask at this point considering and hope it goes out as they promise.

As others have pointed out though, the manner in which they've done it (which I would assume came under advice from their criminal defense lawyers) seems extraordinarily transparent and probably wouldn't stick. <br><br>Personally, I wonder if this means that charges are imminent from the FBI investigation, and this is an attempt to prevent the FBI from seizing their assets (well, their consignor's assets). Knowing that that threat is hanging over them, I just don't know how anyone consigns valuable material to them unless they are truly desperate (i.e., American Memorabilia desperate). <br><br>With their sales already way down (suspiciously after the investigation was announced and after Doug announced Mastro would start keeping bidding records), I just don't see how this rather half-ass attempt at a new incarnation is going to survive. <br><br>I still vividly recall getting an unsolicited call from Doug Allen about five years ago vehemently denying that the fact that Mastro allowed its employees to bid on Mastro auctions was harmful to bidder trust and could give the appearance that shill bidding was going on. It only took five years and an FBI criminal investigation to change his mind. <img src="/images/happy.gif" height="14" width="14" alt="happy.gif"> <br><br>You just know that somewhere Rob Lifson is reading this stuff and laughing his butt off.

Normally that would mean that the purchaser obtains only enumerated assets and leaves the rest behind. Whether the book of future auction consignments is assignable and has been assigned is a good question. You would have to check your Mastro contract to see if they could assign your consignment to another entity. On the older ones I had I did not see anything allowing for or disallowing assignment. Any IL attorneys could better explain those issues. <br><br>Given the way all this went down, I would not consign them a 1993 Donruss set...except with a big cash advance.<br><br>Sic Gorgiamus Allos Subjectatos Nunc

I was one of the consignors and I was paid. It seems like this would be the place for an unpaid consignor to rant and rave and I've yet to see it...rumors and more rumors at this point.

Having a lot of unpaid consignors when none of them are posting on here regarding it...doesn't seem plausible. All holy hell breaks loose on here regualrly when something as small as an overgraded card is sold, a misdated title in an auction listing. That's the great thing of this board, nothing is going to sneak by. If there are a lot of consignors who have yet to be paid, where are they? Why aren't they posting here? That's what I am asking.

I know of 8-10 in total. We all panicked for a couple of weeks. In the end, the panic was for nothing. I was paid, so was everyone else I knew. Two were 6 figure consignors, both were paid. I just haven't seen anything except for rumors.

I leave the identifying and other questions up to the folks that founded this board so enough said.<br><br>I am not sucking up to Bruce and i could care less if he and i have anything in common. What we do have in common is that the Wonka express bash team constantly questions our posts and throws little mental jabs all the time about cards we own and when we respond then the team cries to Leon ohhhhh noooooo please ban please ban.<br><br>I merely stated that Bruce does have a personality and is not afraid to voice his opinion which i respect....also Lichtman's next post is a classic and shoule be nominated for a Network 54 moonman.<br><br>The reason i keep rolling is because there were several e-mails that asked me to remain on the board. Card dealers and other folks stated that who cares what these guys are whining about because if i left then they are just going to find someone else to ride or bash. <br><br>In my league Wonka if you bring your C game then the field laps you and not only do you get buried but the fellows talk mad trash constantly until your game comes back. It is relentless and never ending. God forbid if you whine or complain because then the party really starts.<br><br>Also i will admit that the peppermint rims were clean, kinda of a Jay-Z flav<br>thing you got going on.<br><br>

Posted By: <b>Al C.risafulli</b><p>I liked this thread, and thought it was raising some useful points and discussing some important issues - important to the hobby, and important to the personalities who frequent this board, of which I am still a relative newbie.<br><br>And having been the moderator of several message boards, I understand Leon's challenges and am not the type of guy to criticize a moderator. It's a bitch of a job, impossible to please everyone, tireless and thankless, and not without tons of second-guessers. Leon is a good guy, and it's hard enough to moderate a message board without having guys like me yammering over your shoulder.<br><br>All that said, Marshall came into this thread like a bull in a china shop, just like he does in every other thread. The guy wrecks every thread he enters. If I'm not mistaken - and I don't think I am - Marshall's very first posts on this board were in defense of a dirtbag who was harassing the moderator. His second round were a bunch of sour grapes about grades. Since then, they've largely been storytelling about his, umm, noise.<br><br>He's absolutely useless to the content of the board, but beyond that, he's incapable of participating in an on-topic discussion, incapable of writing in understandable English, and incapable of understanding the basic concept of message board etiquette - you sit on the sidelines for a while, get the feel of a board, slowly and respectfully get your feet wet, and realize who the knowledgeable board elders (of which I am not one) are.<br><br>I dare say that Peter Chao and Adam J. Morraine stayed on-topic. Virtually all the time. Some may not have liked their approaches or the way they articulated their points, but their posts pertained to baseball cards - not to how much reefer they smoked, or to their sexual conquests, or to the clubs they wrecked, or their record deals. Neither Peter nor Adam - nor anyone else who has ever posted on this board - were disrespectful to the board's female poster and readers. Neither of them have ever posted anything on this board - stuff that will stay on the internet forever, by the way - that would shame this entire community. <br><br>Neither of them ever wrote anything that would result in my not being able to let my children read this board to learn about baseball cards.<br><br>It's as simple as that.<br><br>I walked away from this board for a week or two after the last debacle with this guy. After a while, I decided: why punish myself because of a guy like him? I LIKE it here. When this board is operating properly, I can learn things from it - and hopefully contribute something to it as well.<br><br>But if Marshall is allowed to come storming into every thread with his noise, then I'm allowed to write haikus.<br><br>-Al

I don't think it's an &quot;either or&quot; situation. Just as there were 5 locked threads recently in order to get back to cards so will it go in the future. I have asked Marshall to talk about cards (*and really everyone else too) as that is what this forum is about. A little off topic keeps it from being stale but the focus really should be maintained. We will get back there. best regards
