Posted By: dan mckee
Here I go again. I think I am a crook magnet or I have "STUPID" engraved on my forehead! I need some help, opinions, info. I have heard of board members contacting local authorities but I do not know who to call or contact.

I struck a deal off of ebay for 26 items that were similar to the 1 that was sold on ebay. The deal was $4060.00 for 26 items. The seller's son-in-law is actually who I am dealing with. I promptlty sent the money and he cashed my check immediately. Here is where it gets strange. He actually communicates with me but is from another planet.

He constantly assured me that the items were already shipped when they were not. He flat out lies about actually shipping them several times. I have a local lawyer send him a letter and then he finally ships 1 box with just 10 of the 26 items in it. Also, the 10 he sent were glued to wood backings unlike the 1 in the picture.

It has been almost 7 weeks now and he has the other 16 items and my $2500 for them. He keeps promising to refund me but I am just sick of the lies and deceipt. Can I file small claims in Maryland and have him come to me? Do I call his local Sheriff's department or DA? Any help is greatly appreciated. My goal is to get the $2500 back for the 16 items he hasn't sent.

This board has helped me greatly with far worse situations so once again, I am in need of some guidence. Many thanks Dan.

Posted By: Steve
Simply let him know that you are contacting lieutenant _____ of his local PD... Get the "interet crimes" officers name and forward it to the seller. This has been a positive motivator in the past for my scammer encounter.

Posted By: dan mckee
Is this something I can actually do? Because I have mentioned similar threats like this to him and he just doesn't get it. Dan

Posted By: Jeff
Your local lawyer should be able to answer those question specifically, but if he can't, I think I can (I am in Washington DC)... message me here or at jsherman@semmes.com .. thanks!

Posted By: scott levy
1) It is expensive and time consuming, small claims court is better but can still take some time.
2) It only works if the person has real assets to go after, which unfortunately isn't often when you are dealing with criminals.

Good luck though!
-SGL

Posted By: Dave F
I do know that unfortunatley you do have to file in the person's district that they live in...it can't be as convenient as doing it where your at in Maryland Dan. I had a similar situation with a guy up in NY and once I called his local authorities and had a report filed I magically got my money back.

Posted By: Jeremy
Dan - I live in Tennessee and our TBI (Tenn Bureau of Investigation) has a Internet Crimes Division. Google and contact them online possibly and let the person know you will be doing this as well. This might freak him out that you know this and more importantly, the TBI in Nashville can probably help along with local authorities.

Good Luck,

~ Jeremy ~

Posted By: Chris
File a complaint here: http://www.ic3.gov/

They'll review it and send local law enforcement. They can't "do" anything, but maybe it will scare him enough to actually send the items.

Posted By: Jodi Birkholm
Two months is too long. Four grand is too much. Trash away! I've only been taken once on eBay. Thanks in part to an overcropped scan, I spent $2500 needlessly. Stay away from any items offered by Heriberto Feliciano of Puerto Rico (eBay name thelegend21).
