Posted By: Shawn Chambers
Hey guys,

Just saw a video on MSN about another Wagner that "fell out of a kitchen ceiling" or something...

Have any of you guys seen this or know of this find. I don't have the link, but it is in the video section now on msn.com homepage.

They keep insisting it's worth "millions", but it looks like creases o' plenty to me...

Shawn

There are plenty of idiots out there willing to be interviewed. How about a reporter that actually does a little research?

They havent found this site yet? or the t206 museum site? or asked someone who knows vintage cards yet? you have at least 100 people who come to this site who dont even have to see the card in person to tell him its not real....and who has 60k just lying around but is worried about paying their house off? what did he do,buy a million dollar house on a middle class salary with hopes that a Honus Wagner card would just fall out of the ceiling to help him pay for it?

Posted By: john/z28jd
As much as i was joking,I know someone personally who had a bunch of Mickey Mantle cards from when they were a kid including at least 3 of his rookies he says, and hes a very honest person so i trust him (after i quizzed him about it) and when he went to college he put those cards in a box along with some other things and put it under a floorboard he took up in his room. His parents sold the house in the meantime and he never got the cards, but the cards werent worth anything back then so besides sentimental reasons, there was no reason to tear up someones floor to get his cards. So unless theyve been found already, theres someone in upper NJ who has a small fortune in Mickey Mantle cards right under their feet and doesnt know it

Offer to show them where and to split the proceeds of sale. If they decline let them tear their house up looking for them.

Posted By: Steve Murray
After my post I started to think and have another theory.

Question? Don't the cards still belong to the original owner?

Some may say that they have been abandoned. But don't you have to have someone find them first before the original owner can be deemed to have abandoned them. If they are not abandoned then the current owners have no legal claim and the original owner should be able to reclaim them.

The manner of recovery may be in Replevin?

Interesting thought that I'd just throw out for all you other lawyers to pick over.

Posted By: john/z28jd
I was wondering that too Steve but my thinking was if you buy a house you buy its entire contents that are left once the previous owner moves out. The fact that he could help them out financially might be enough motivation for them to let him look but if someone came to my house claiming they have something valuable from when they were a kid and they want to tear up some floorboards,i dont know if id be too anxious to just let them in and tear away. Id take their number maybe and do it after they leave

Posted By: Steve Murray
I'm not sure about that. I seem to recall a case here in Illinois where the new owner found a shopping bag full of cash (true)left there by the previous owner and laid claim to it. It was determined, I think, that the cash had been "mislaid" and not "abandoned" so the prior owner recovered the cash.

Now here we get into the issue of what has been "lost" and found; "abandoned" and found; "mislaid"; and "abandoned" but not found. Not my area of expertise.

Max:

For "trover" to apply the cards would have to first be deemed to have been "lost" and then found and then withheld from the true owner.

I still go with Replevin.

Personal property such as Honus Wagner cards are not fixtures.

It will depend very much on the facts of each case, including the wording of the contract and the actions of the parties, and whether there is any specific legislation in the particular jurisdiction which would modify the common law treatment.

Max

Seems like the only "old" cards I ever find are Julio Gotay, or Cesar Geronimo, or Ty Cline (not Ty Cobb).

I do have an uncut sheet somewhere that has the famed Kevin Maas rookie card on it. Maybe I should put that up in the attic?

Posted By: Rick McQuillan
I think we have finally stumbled onto the reason why there are so few Wagners around. They didn't come in tobacco or cigarette packs, but they were inserted as premiums in bags of attic insulation. Did Piedmont 350 actually refer to the "R" value of the insulation?

Gotta run. I'm grabbing a flashlight and a ladder and heading for my attic. When I'm done with mine I'll head for my in-laws house.

Rick

Posted By: David Smith
Rick,

Forget insulation, they might have just been inserts with the HOUSE! The builder would build the house and insert the card somewhere and the owners would them have to try and find it, if they were so inclined. Most people back then didn't care so the cards just stayed where they were until later owners were doing renovations on the, now, old house.

To all,

All of this talk about cards falling out of walls and ceilings and being found in attics makes me want to go back to where my Grand-Mother was born and raised. She was born in 1920 on a small farm in Kentucky. Her family was poor and this place was in the sticks, as they say. I went there when I was about 10 or 11 years old.

At the time that I went there (in the late 1970's) the place was STILL out in the sticks and the house was abandoned. My Grand-Mother explained that when she was young, her family didn't have money for insulation so they used newspapers. Sure enough, inside the house, glued to the walls, were layers of newspapers.

When I went there, my Grand-Mother found a sports page and tore a story off for me. It had a headline and story about Babe Ruth hitting a Home Run and was dated in the late 1920's. I don't remember the exact details but it seems the Yankees were playing the A's that game. I don't have that piede of paper now because it eventually crumbled and turned to dust.

Anyway, I have sometimes wondered what else was glued to those walls or tucked inside of them? I didn't know it at the time but she said there was also a small attic in the house. Another member of our family went to the house at a later date and said there was still some stuff up in the attic when he cilmbed up there to look around. He said there wasn't anything valuable but, then again, he didn't collect cards or sports memorabilia and wasn't really into antiques.

David
