Not too long ago I saw a member post on a listing he was upset another member sold a card before he had enough time to respond to a counter offer, and seemed to believe the seller should have waited for his response. I recently found myself in a similar situation, having sent a counter offer, received no response, and then received a different offer that I accepted. I quickly updated my post that the item was sold and messaged the member and let him know. He did respond and said thanks for letting him know and that was the end of it.

My thought is that if there is no commitment to buy the card is fair game and a seller should be free to sell to anyone. But if you send a counter offer should you wait any certain amount of time for a response before selling to someone else? I am by no means asking if this should be a rule, just curious what other members think.

In my opinion, until the buyer agrees to the seller's price (or counteroffer), the card is still available.

Just make your terms clear in your listing, i.e. that acceptance takes precedence over negotiations or whatever.

Exactly. I try and say, "A commitment to buy takes precedence over ongoing negotiations" or something like that.

I think Scott is probably the best at this. Every time he lists something he has something a long the lines that "I will take it" voids any ongoing negotiations.

Here are the rules (below) from the friends over at Blowout, a mostly newer card forum. I do post infrequently there but haven't bought or sold any. We could institute these if ya'll want? Their auction rules are below the regular ones...

Be careful when doing any transaction online! Blowout Cards is not responsible for any transactions. However, we have these rules in place to help protect our members whether they are buying, selling or trading. Use caution and Report any suspicious activity to us right away!

Check Buyer/Seller feedback. We have the iTrader feature so that you can view a member's b/s/t history here on our forums. Also, if the user has their eBay ID posted, please check their feedback there as well (be sure to verify that the username since the member can edit this field).

Use Tracking or Delivery Confirmation. When sending items to another member, please use tracking or delivery confirmation so that there is some proof of delivery (if you know a member very well or if the card is not worth very much, you can ship w/o tracking at your own risk).

Use Paypal to protect yourself (Sending payment as a gift is the same as sending cash or a money order!). Paypal is convenient and safe for buyers, especially if you are buying from someone new or with someone you don't know.

Asking for Paypal Gift payments is NOT allowed. Please be aware that if you send payment as a GIFT, you will NOT be able to file a claim if there is a problem with the shipment. Sending payment as a gift is the same as sending cash or a money order! We do not recommend sending Paypal payments as a gift.

Include a price for each item in the first post of your thread (Buying or Selling). If you're buying or selling, please POST A PRICE! Failure to do so will result in the thread being deleted. Prices must be posted for every item that is for sale; if you are selling a lot, only a lot price is necessary but if you start to sell individual items, then individual prices are required. Pictures are always helpful too. We want to avoid situations where things are misleading or not clear...we want all B/S/T threads to be as clear and concise as possible. Outrageous and unreasonable prices may result in your thread being deleted; it is the same as not posting a price at all. If you want to run an auction, please list on eBay.

No Auction type threads - This includes threads that ask for the best card for a certain amount of money (ie. I want the best card/lot for $$XX threads). If you've got some money and are looking for something specific, make sure your title and description reflect exactly what you want (teams/players).

Photobucket/CMB Threads - If everything is priced out, these threads can be posted in the normal B/S/T area. However, most are posted without pricing and since this is a very popular way to trade, we will allow these to be posted, but only in the Spam Section (Spam your eBay & COMC listings here! (Photobucket, Sportslots, Sportsbuy, etc.) - Blowout Cards Forums)

Post a Clear and Informative Subject - Try and use the following format so that your thread title is more informative; this way someone will know by reading your title/subject if they are interested and don't have to waste time checking every thread that says "L@@K HERE! Wow!" Start your post with the following codes in the Title to verify what your B/S/T thread is about. If it is something general and the codes don't apply, just be sure to enter a good description in the subject and in your post whether it be for singles, parallels, inserts, or sets.

FS: For Sale
WTB: Want to Buy
FT: For Trade Only

Examples of a good titles:
FS: 1952 Topps Mickey Mantle Rookie Card. Excellent condition.
WTB: 1986 Fleer Michael Jordan Rookie Card graded PSA 9 or better.

Keep your thread updated. If your item sells, go back and edit your first post with ** SOLD ** at the top. This way people don't waste time viewing it if it's not available anymore. If it's a want list, update the first post instead of posting updated lists...this way others won't have to read the entire thread and start a spreadsheet to figure out which cards you still need.

Items for sale or trade must be in your possession. Selling items that are incoming or not in your possession is NOT allowed.

Multiple threads/Keep the clutter to a minimum. You should never have more than 1 active thread in each b/s/t sub forum at any time. Creating multiple threads for single cards all at once is not acceptable. We understand that old threads may be bumped and that is out of your control, but please do not post multiple threads at once - especially for single cards. If you see an old, outdated thread of yours being bumped, please edit out the OP and request the thread be closed (). When possible, combine all your cards into 1 thread. Excessive threads will be deleted or merged.

Duplicate threads not allowed. Do not post the same item more than once or in more than one place. Excessive threads will be deleted or merged.

No wax transactions please. This includes selling and trading of packs, boxes, cases, and factory sets.

No supply transactions. No supplies should be bought, sold, or traded on the forum. This includes toploaders, magnetics, boxes, etc.

No Blowout Gift Certificate or Gift code sales. Please no selling of Blowout Cards gift certificates and/or credit.

No COMMERCIAL posting allowed. - The B/S/T Forums are for Blowout Cards members and collectors to trade and sell among each other. All commercial posts will be deleted.

New User Restriction - To protect our members from quick buck scammers, we may ask new users who are selling to post some sort of reference such as eBay feedback.

No Raffles, Grab Bags, Mystery Packs, Hot Packs, etc. - No Raffles or any other similar postings. Only straight up buying, selling, trading. The more detail you post about what your looking for, the quicker your likely to get a response you need. IE I've got 20 Paypal and looking for 2008 Topps Chrome Copper Refractors for my set. Do not post you've got Paypal and looking for a "lot" (or autos, or jerseys)...be as specific as possible and the thread will likely not be deleted.

Bumping - Do not bump your thread. You may reply to questions about the op, but may not post consecutive (back to back) posts until at least 24 hours have passed. Do not ask friends to bump your thread. Do not create duplicate threads to avoid the bumping rule. Violations will result in the thread(s) being deleted and may result in a suspension from the forum.

**Auction Rules**

Rules For Sellers:

1. Please use the sample post template (just copy it and paste it in your auction). Fill in all fields of the sample post template. We want uniformity with our auctions to avoid any confusion.

2. You may post auctions if you have been an active forum member for the last 3 months, have no negative iTrader in the last 6 months, and are at least 18 years of age. Please feel free to post in each section. As we grow, the limit may be placed. If we have too many auctions in one section, your auction may be moved to end on another day.

EDIT: No limit on auctions posted per member for now, but we may implement a cap if the sections start to grow beyond 1 page.

3. At this time, you may only accept Paypal Goods as payment. No gift, no cash, no TTM, no alternative payment sources.

4. Each subforum has an end time and day. No post that is time stamped AFTER this end time will count. There are absolutely no exceptions. You may not extend your end time or date.

5. Your title must start with the player's name and be followed by the set & card #. Do not keyword spam your title.

6. At this time, only single cards or small (2 or 3) card lots may be auctioned. You must have a CLEAR scan of the front and back of the card. You may include additional images by linking to your photobucket. Photos may be used instead of scans only if they are extremely CLEAR. You must not have this item for sale anywhere else (eBay, COMC, B/S/T, or other forums) as the bidder must have confidence that the winning bid gets the item.

7. You must set a starting bid. This may be as low as $1.00 and as high as you wish. High starting bids may discourage some bidders, but it may also be used as a reserve by setting the starting bid at the lowest price you will accept.

8. You must state when you expect payment. If you grant an extension to a buyer, it must be noted as an edit at the bottom of your OP. (More on edits below.)

9. You must clearly define your shipping terms. You MUST ship with tracking - no exceptions. You may include insurance in your shipping fees or offer insurance as an option. Remember, insurance protects you as the seller. You may not charge more for shipping than is posted here - so be clear. (You may come to an agreement with your buyer for different shipping arrangements, but you may not arbitrarily decide to charge more for shipping.)

10. Clearly state when you will ship. If you say you will ship within 24 hours of payment, make sure that you actually ship within 24 hours of payment.

11. You may set bidder restrictions by iTrader and/or location, but you may not restrict bidders by join date or post count. If there are members who you wish to block from your auctions, send them a polite/professional PM to not bid on your auctions and save the PM.

12. We want your scans to do the talking, but you may wish to include a few additional details about the card in the description. Please do not use different text font, size, or color. Keep this simple.

13. Return Policy: Paypal protection will apply to every buyer and seller, but you can make this simpler by posting a return policy. You may choose to have no returns, but Paypal may have the final word on that.

14. You may NOT post in your auction after your original post. You may not bump your auction or add details/comments in later posts.

15. Edits. You must leave your original post EXACTLY how it is. However, you may add an edit(s) to the bottom of your auction. This is where you can address questions and allow exceptions:

Quote:
EDIT: (9/28 12:07PM) There is no corner damage at all. The glare in the bottom right corner is just from the scanner.

EDIT: (9/29 12:08PM) JOEBLOW is welcome to bid on this auction even though he has had a negative iTrader in the last 6 months.
16. Once the auction is over, please send a pm to the winning bidder with your paypal email address (do not post this in the thread). You may wish to get their email address and send them a paypal invoice instead.

17. Once your transaction is completed and the buyer has expressed their satisfaction with their card after it arrives, please leave appropriate feedback.

--------------------------------------

Rules For Bidders:

1. As long as you pass the bidder restrictions in the auction, you are welcome to bid on any auction. Your post only needs to include a price, but there is a 10 character minimum to every post (sorry). So you will need to post something like "$10.00 Thanks."

2. You must bid in increments of at least $1.00 and only in full dollar amounts. $10.00 is correct. $10.01 or $10.27 is incorrect and will not count. In the event of a tie bid, the bid posted first is the high bidder.

3. By bidding, you agree to the terms listed in the OP of the auction. You may not retract or edit your bid. If someone beat your bid just before you posted, do not edit your post. You are welcome to place a new bid as long as time allows.

4. Absolutely no bumping or trolling. You may only post bids - please leave any and all commentary to the proper forums.

5. If you create an additional account to shill bid, you will be banned.

6. Sniping is not recommended. If several people snipe at the same time, they may create a momentary server load. This can delay the actual posting of your bid. No bid that shows up after the end time will count (even if you clicked the post button in time). There are no exceptions. For a 10:00 end time, a post time stamp of 10:00 is ok. 10:01 is too late.

7. If you know you are on the seller's ignore list or if you have had issues with the seller in the past, please avoid the auction. If you truly wish to bid on the item and are not sure if you are welcome, please send the seller a polite PM to ask. Please respect the seller's decision though if the seller asks you not to bid.

8. You must pay on time. You will owe your full bid plus any shipping fees included in the auction. Paypal Goods is the ONLY acceptable method of payment.

9. Once your transaction is concluded, please leave appropriate feedback.

10. You are welcome to ask questions via pm to the seller. The seller can also post your question & answer at the bottom of the op as an edit.

I would add Rule #3824 below

3824. A complete list of these rules must be posted with every listing and response to assure that all parties are aware of the rules.

Maybe a little "I agree" button could be added as well.

Just make your terms clear in your listing, i.e. that acceptance takes precedence over negotiations or whatever.

If it ain't broke don't fix it. Especially with rules.

Agree with both posts, we don't need more rules and if someone says they will buy it at asking price too bad for the guy trying to get it cheaper.

Nothing wrong with trying to get a better price but you take the chance of losing it to someone who will pay full asking price while you negotiate.

To me this just seems like common sense and I don't feel the need to add it to my listings.

To Leon we didn't have much luck reaching a consensus even adding one of those rules, requiring prices with for sale listings. But if you want to add all of those rules I wish you good luck with enforcing all of them :)

I agree with all of the above posters that an offer to buy takes precedence over any ongoing negotiation. This situation has happened to me a couple of times as somebody making an (generally unreasonable lowball) offer has been upset that I sold the card to another buyer who wanted it at my full asking price. I'm not sure what they expect the seller to do...say "No thanks, I'm not going to sell to you at my listed price because there's another guy who maybe wants to buy it for less and maybe I'll hear back from him in 2-3 days...or never." Just kind of common sense, I think.

I agree with this. It seems like common sense. Anyone who gets upset that the card sold while they were trying to negotiate a lower price is not being reasonable. They are probably more annoyed at themselves for not pulling the trigger than anything. No logical thought process ends with the negotiator being upset in this scenario.

Speaking of rules.

If you post something in Ebay, Auction and other Venues Announcement- B/S/T, how often should one be allowed to bump their posting?

I rarely post anything there, but when I do I am never sure whether I should bump at any point.

I have seen people bump their postings as thou they are the only ones posting.

Every 3 or so days sounds about right to me....but there isn't a rule and I don't want one!! :) And actually the live auction section really has about the only rule and that had to be...Since they are timed 1 member shouldn't have more than 2-3 open at once.

I try to only bump once...usually the last day.

I may bump more often depending how many posts ending after mine show up above (after) mine....that just seems fair to me.
