I may as well get the formalities out of the way since there's bound to be a bit of controversy.

My name is Steve Birmingham.

I posted a while back about historicauctions on Ebay reneging on an auction I won. I filed a complaint with Ebay over the nonperformance - Ebays word for it. After waiting a few days to see if that changed anything I left negative feedback. At the time I made the complaint I asked Ebay about my concern that they might file an unpaid item dispute in retaliation and was told not to worry since Ebay had their message sent through Ebay claiming the item had been sold 2-3 days before it closed.

So today they opened a nonpaying bidder complaint. And the negative feedback was removed.

4 hours on the phone with Ebay and all they can offer is to let the complaint go through, then file an appeal. So for having done nothing wrong, I get the hassle of defending against their bogus claim!

My other option is to pay and then complain when the item isn't sent. But of course they'll probably send an empty envelope or a couple reprints and it will be an even bigger hassle to get the money refunded. :(

So which way would you handle it? I can't leave negative feedback for them unless I pay for something I'll never get.

On the plus side it lookslike they may be suspended. The ebay rep said they still have items up because if an item was listed as 30 day or good till close it's allowed to remain until it ends even if the user is suspended. Loophole anyone?
